General Terms and Conditions of BAS World

The website of BAS World is operated by BAS World B.V., with its office located at Mac Arthurweg 2, 5466 AP Veghel, hereinafter referred to as BAS World. These terms and conditions apply to all agreements entered into with BAS World and to any use of the website basworld.com.


1. Operation of BAS World and Obligations of BAS World

1.1 BAS World provides an online platform where (potential) buyers and sellers of vehicles, particularly commercial vehicles, are brought together. Buyers and sellers each enter into an agreement with BAS World regarding access to and use of the platform under specific conditions. BAS World is not a party to the sales agreement ultimately concluded between the buyer and seller.

1.2 Buyers and sellers gain access to the platform through a login procedure as described in Article 2. Sellers must comply with the obligations in Article 3. Buyers must comply with the obligations in Article 4. The offered vehicle must meet the requirements set out in Article 5. The fee to BAS World, the commission, is governed by Article 6. All parties, including BAS World, the buyer, and the seller, must adhere to Articles 7 and 8.

1.3 BAS World organizes auctions on a regular basis. BAS World reserves the right to suspend or cancel an auction without prior consultation or liability. Additional auctions may be organized at its discretion. BAS World commits to auctioning a listed vehicle at least once for the seller.

1.4 During an auction, vehicles are sold using an auction clock. Only bids placed within the duration of the auction clock are accepted. BAS World uses an extended auction clock if a bid is placed within the last minute. BAS World's time registration system is binding.

1.5 A bid is placed by the buyer using the designated module and is displayed exclusive of VAT. Bids on vehicles with a BPM construction are exclusive of BPM and VAT. BAS World is not responsible for any errors in BPM specifications.

1.6 An agreement is concluded between the seller and the highest bidder at the end of the auction, provided the bid exceeds the minimum price and the hidden execution value. The seller may choose to accept a bid below the execution value.

1.7 BAS World connects the buyer and seller through automatically generated emails. The buyer and seller handle the completion of the sales agreement themselves. BAS World does not mediate in the execution of the agreement.

1.8 BAS World offers sellers the opportunity to specify vehicles using completed forms. BAS World does not verify these specifications and is not liable for errors. Misleading specifications may result in exclusion from the auction.

1.9 BAS World does not guarantee the seller's authority to dispose of the vehicle.

1.10 Unsold vehicles may be listed separately after the auction and sold at a later time. All provisions of these terms and conditions remain applicable.

1.11 BAS World may conduct creditworthiness checks on buyers. However, BAS World is not responsible for the buyers' payment capacity.

1.12 BAS World handles complaints from buyers and sellers and may impose sanctions if necessary, including exclusion from the platform.

1.13 BAS World reserves the right to perform a credit check during registration. Findings will not be shared.


2. Login Procedure

2.1 Access to the platform is granted through a login procedure. BAS World activates registrations after verification within 24 hours on business days.

2.2 Usernames and passwords are personal. Misuse of login credentials is the user's responsibility.

2.3 BAS World may refuse registrations due to insufficient creditworthiness.


3. Selling Party / Seller

3.1 Sellers must specify vehicles fully and accurately. Sellers are liable for damages resulting from discrepancies.

3.2 BAS World may refuse vehicles with incorrect specifications or unrealistic minimum prices.

3.3 Listed vehicles must remain available until the day of the auction. Costs may be charged for earlier sale or loss.

3.4 Sellers are responsible for invoicing and delivery.


4. Buying Party / Buyer

4.1 A bid is binding. Buyers commit to paying the purchase price and commission to BAS World.

4.2 Buyers are responsible for ensuring the seller fulfills the agreement.

4.3 In case of discrepancies, buyers can only hold the seller accountable.

4.4 Buyers violating the export clause are liable for a penalty to the seller.


5. Object / Vehicle

5.1 The vehicle must match the specifications provided by the seller.

5.2 Delivery must take place within three months of the auction date unless otherwise agreed.


6. Commission

6.1 Buyers and sellers owe a commission to BAS World upon the conclusion of an agreement through the platform.

6.2 In case of non-fulfillment of the agreement, the defaulting party is obliged to pay the full commission.


7. Liability

7.1 BAS World is not a party to the agreement between the buyer and seller.

7.2 BAS World is not liable for defects in delivery or payment between the buyer and seller.
